1. Agreement to Terms

By accessing or using Mox ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service. This Service is operated from New Zealand and is subject to New Zealand law.

2. Description of Service

Mox is a product discovery and aggregation platform that allows users to browse, search, and manage products from various Shopify stores. The Service aggregates publicly available product information from Shopify stores and presents it in a unified interface. We do not sell products directly; all purchases are made through the respective Shopify stores.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all applicable subscription fees as described on our pricing page
• Provide valid payment information through our payment processor (Stripe)
• Automatic renewal of your subscription unless cancelled before the renewal date
• All fees are in New Zealand Dollars (NZD) unless otherwise stated

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial subscription periods, except as required by New Zealand consumer law.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without permission
• Reproduce, duplicate, or copy any part of the Service without authorization
• Transmit any viruses, malware, or harmful code
• Impersonate any person or entity or misrepresent your affiliation

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Mox and are protected by international copyright, trademark, and other intellectual property laws. Product information, images, and descriptions are the property of their respective Shopify store owners. We aggregate this information under fair use principles for the purpose of product discovery and comparison.

7. Third-Party Links and Services

The Service contains links to third-party Shopify stores and websites. We are not responsible for the content, privacy policies, or practices of these third-party sites. When you make a purchase through a linked store, you are subject to that store's terms and conditions. We do not process payments for products; all transactions are handled by the respective Shopify stores.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. Product information is aggregated from third-party sources and may not always be accurate or up-to-date. We are not responsible for pricing errors, product availability, or discrepancies in product information.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, Mox shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Consumer Guarantees Act 1993

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Consumer Guarantees Act 1993 (NZ) or any other applicable New Zealand consumer protection law that cannot be excluded, restricted, or modified by agreement.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand.
